DAVID F. WALIA, Toronto Criminal Defence Lawyer

David F. Walia is a criminal defence counsel whose perspective is shaped by experience on all sides of the courtroom: he began as a prosecutor in Pima County, Arizona, later practiced in antitrust and white-collar groups at a Big Four firm, and—after returning to Canada—served with the Crown before dedicating his practice to defence. His approach is client-centred and measured: he explains the process, options, and risks; presses Charter and evidentiary issues early to build leverage; negotiates firmly when resolution serves the client; and tries cases when it does not. He has a strong track record in bail court—including special bail hearings and reverse-onus matters—crafting rigorous supervision plans and targeted submissions that secure release. While he does not shy from conflict, he values open, civil collaboration with the Crown when it achieves a just result. David defends matters from simple assault to homicide and represents clients in parole proceedings. His writing has appeared in the Dispute Resolution Journal on securities arbitration, he is the author of a book on the Second Amendment (firearms), and he has successfully brought Charter applications excluding drugs and firearms where racial profiling and unlawful searches were at issue.
