What is the Difference between Murder and Manslaughter?
The difference between murder and manslaughter is intent. In order to be convicted of murder, it must be proven that the accused intended to kill the victim. If the accused did not intend to take the victim’s life, manslaughter is the more appropriate charge.
One of the many strategies we use is to have charges of murder reduced to manslaughter, which carries less severe consequences, by questioning the accused’s intent. We may be able to argue that the accused was intoxicated and could not form the necessary intent to kill the victim or that the accused simply intended to hurt, not kill, the victim.
It is up to the Crown attorney to prove the accused’s guilt beyond a reasonable doubt. Our lawyers will fearlessly challenge the Crown’s evidence, exposing areas that leave room for reasonable doubt. There are also many defences that can be raised against murder and manslaughter charges, such as self-defence, which can result in acquittal.
Skilled Defence Against Attempted Murder Charges
The potential sentence for attempted murder is that same as that of murder: life imprisonment. This offence also carries minimum mandatory sentences (sentences that must be imposed upon conviction) in certain circumstances. For example, if a firearm is used in the offence, a conviction will lead to at least 4 years in jail.
